A coffee company has filed a lawsuit against Liquid Death to prevent the sparkling water company from releasing a line of coffee drinks.
Liquid Death has become widely known thanks to its canned sparkling water, but the company is no stranger to offering other types of beverages, like tea and its energy drink line, which will release in January 2026.
The company has gone viral for its wild flavor collabs as well, including Hot Fudge Sundae and Fruity Pebbles flavored sparkling waters.
Among all of its new flavor releases, Liquid Death has applied to trademark the name “Liquid Death Deathuccino” for use in connection with coffee-flavored drinks – and one company has made it clear they’re not happy about that.
Liquid Death sued by Death Wish Coffee
The complaint was filed by Death Wish Coffee on October 7, asking for the court to prevent Liquid Death from releasing the alleged coffee-flavored drinks as they would “confuse customers” and “irreparably harm Death Wish and its valuable brand.”
“Death Wish brings this action to enjoin Liquid Death from confusing consumers and trading on Death Wish’s brand and goodwill by launching competing DEATH-branded coffee beverages,” reads the lawsuit.
“Straying from its current business of selling sparkling water under the “LIQUID DEATH” brand, Liquid Death recently applied to register the trademarks LIQUID DEATH and LIQUID DEATH DEATHUCCINO with the United States Patent and Trademark Office for use in connection with coffee and coffee-flavored beverages.”
The complaint went on to claim that Liquid Death plans on releasing a coffee-flavored drink sometime after the beginning of 2026.
Liquid Death responds to lawsuit
On October 9, just two days after the lawsuit was filed, Liquid Death shared the news about the complaint in a post on X.
They also claim that they have no plans to actually release a coffee drink.
“Well, DeathWishCoffee and their lawyers have filed a lawsuit in an attempt to stop Liquid Death from ever launching our own brand of coffee,” they said in the post. “BUT we have no plans to actually launch a coffee.
“And whether or not we ever go into coffee one day, we don’t believe any one company can legally own the word DEATH regardless of how it’s used. And since Death Wish publicly filed their lawsuit against a Liquid Death product that doesn’t exist, feel free to let them know on their socials whether or not you support their case.”
